For all intents and purposes, legal separation follows the exact same processes as divorce, without the finality that comes with it. This means you must address all necessary issues in your separation agreement, including:
- Asset/property division: Who will live in the family home? Will you need to sell any belongings?
- Debt division: Who pays the mortgage? Who covers the credit card bills?
- Spousal maintenance/alimony: Will one spouse require financial support during the separation? If so, how much?
- Child support: Children must be cared for during the separation. How will the costs of raising your children be divided?
- Child custody and visitation: Where will the children live? How much time will the noncustodial parent be able to spend with the children?
Steps to Take After Obtaining Legal Separation

- Reconciliation: If you wish to reconcile with your spouse, all you need to do is file a dismissal request with the court. This will end your separation and enable you to move forward as partners again.
